Mortgage loans play a vital role in the real estate industry. These loans are mainly taken out to purchase some real properties. However, before taking out a home mortgage loan, it is important to know about the different mortgage rates available at the market place. Again, if you are facing difficulty in making mortgage payments, you can opt for refinance home mortgage. Refinancing makes the mortgage payments more affordable to you. Anyways, the mortgage industry as a whole is governed by various mortgage laws and regulations. These laws relate to different aspects of mortgage such as lending practices of the lenders, licensing of the brokers, foreclosure laws, mortgage disclosure, protection of the rights of the borrowers and many other issues. Anyways, here we briefly discuss about some of these laws which are very important for the mortgage industry.

Real Estate Settlement Procedures Act

Real Estate Settlement Procedures Act (RESPA) has been developed to protect the interest of the consumers. The main aim of this law is to do away with the referral fees which unnecessarily raise the cost of settlement services. This includes purchase loans, equity lines of credit, property investment loans and refinances.

New Homeowners Protection Act

This particular law is applicable to the mortgage loans originated on or after 29th July, 1999. By this law, all the lenders are liable to provide notifications and disclosures related to private mortgage insurance (PMI). By this law, lenders are required to inform borrowers about their rights. This law however does not take into consideration FHA and VA loans.

Home Mortgage Disclosure Act

The Home Mortgage Disclosure Act (HNDA) came into force in 1975. According to this act, all the lenders should disclose loan date. Mortgage lenders, credit unions, banks and other financial institutions come under this act. Date reported by threes organizations can be used for various important purposes.

Fair Housing Act

By this law, any kind discrimination by different types of lenders are completely prohibited. Under this law, a borrower should not be discriminated on the basis of religion, sex, race, nationality, disability, family status etc.

Apart from these, there are many other mortgage laws governing the mortgage industry.

Selecting suitable car insurance quotes is very important for you to get enough discounts on your auto insurance policy. The amount of money you pay each month towards your insurance policy is affected mainly by the amount and type of coverage that you select along with other factors. There are a number of insurance companies that make money by selling you more coverage than what you actually need. Thus you should not get instant car insurance quote in order to buy auto insurance. You should look though a number of policies before coming to a decision. Such informed decision will provide you with the amount of coverage you need without wasting money. One of the best ways of reducing your high monthly premium on your auto insurance is to choose a suitable deductible.

The deductible that you pay is basically the amount that you need to make as down payment or out of your own pocket before your insurance goes into effect and cover the remaining balance on the claim. You should be especially careful if you are buying a policy from an agent. Most of the times the deductible an agent will quote, after describing the features and benefits of particular policy will result in the insurance provider gaining great benefits. Most people are unaware of the fact that they can change the amount of deductible and make it higher or lower as per your convenience. If you choose a lower deductible you have to pay premiums every month that are higher. This is because the insurance company will have more liability to pay for you when you cause an accident. Thus it is better that you choose higher deductible in order to make your premium payments lower. You will see that you are at a better position if you consider the whole year round when you are paying more deductible out of your own pocket and lower premiums.

You can consider a hypothetical situation where you go without an accident for around three-four years. The amount of premium you provide as additional payment can mount up to hundreds of dollars. Thus if you pay a little larger deductible then you will be able to pay lower premiums and thus save hundreds of dollars on your car insurance cost.

In answer it might affect your insurance. Depending on the claim. Every case has to be taken separately. You should explain all issues to your insurance company at the point of claim as well you lawyer.

To explain, no win, no fee might have its negative conotations and press but the greater benefits more than negate them. Like legal aid, ‘no win, no fee’ can help ordinary people when they’re confronted with an overpowering legal system. We don’t want a system, like the old days, where only the very privileged and where the only people with access to the law are those with wealth and power?

Because that is what these reforms will lead to.

In terms of your personal insurance then every policy is different. insurance companies’ policies may be affected. There are extremely worthy insurance companies offering everything from home insurance to policies against libel, that may have had impact on a no win no fee case. But it’s best to read the policy fully.

In short you’ll have to check with your insurance company.

The best advice with regards to doing a law degree is to do it quickly. Get it started this year and you will avoid the big rise in University tuition fees. However, you will still need to find a way of paying for the tuition and your living expenses.

Many studies opt for getting a student loan. This can be a good option because they do not charge interest while you are still studying and you normally do not have to pay them back until you get a job which pays a decent salary. However, it can still be very daunting having to start your working life with such a big debt.

One way to help yourself is to save hard before you start. Many choose to delay for a year and work, to save up money to help pay for the living expenses and the course. This can be a good idea unless you are able to start study this year and then you should start as soon as possible, as mentioned above. You could work while you are studying, many students do a part time job and this can help a bit, but if it stops you being able to get such good grades, then this could not be a good plan.

If you are thinking of getting in to law, then you need to be aware of how difficult it can be. You may think that it will be a great job to be in. Solicitors are well known for being paid well and having lots of work. It might seem like the perfect job.

However, the training is difficult and takes a long time. Many people find that they do not manage to pass the training course. You may also be self employed and this means that you will have to work hard to get clients and this could be difficult for you and so you may not manage to get a good income. You also need to stay up to date with current cases. You need to be aware of the results of cases so that you can quite these during your case. This means that you have to work hard all of the time making sure that you keep up to date.

So although it is a well paid job, it is hard work, not just to do the job but also to train and you may find that there are easier options for you, than being a lawyer.

The Scottish Law Commission has put forward proposals to clean up Scottish bankruptcy laws.

A paper on consolidating existing bankruptcy legislation has published a consultation, it said the Bankruptcy (Scotland) Act 1985 had “lost coherence” after being heavily amended in recent years.

It added the proposals were intended to “remove anomalies, treat like cases in the same way or to omit provisions that no longer serve any purpose”.

But the commission said the legislation had since been heavily amended, most notably by the Bankruptcy and Diligence etc. (Scotland) Act 2007.

“Many of the provisions of the 1985 act are excessively long and the structure of the act has become difficult to follow with the result that the act has lost coherence.”

The commission said it was also inviting suggestions for other amendments which would “seek to tidy up (as opposed to reform) the 1985 act”.

Commission chairman Lord Drummond Young, said: “It is essential that the law in important areas such as bankruptcy should be stated in a clear and accessible form.

He went on to to say “The existing statutory provisions dealing with bankruptcy are lengthy, are cumbersome and difficult to use.

“Our aim is to remedy this by restating the law in a single coherent act. This will, we think, be of great assistance to all those who become involved in bankruptcy procedures.”

The commission has prepared a draft of a Bankruptcy (Scotland) Bill to consolidate the legislation and an order which would give effect to some provisions of the bill in other parts of the UK.

An online petition at epetitions.direct.gov.uk demands welfare-dependent rioters convicted of offences linked to the recent disorder around the country, surrender their state handouts.

Now over 100,000 people have called for convicted rioters and looters to lose their benefits saying they show a disregard for the country that provides for them.

Manchester and Salford councils have already promised to take the action necessary against looters, including evicting them from council properties.

The moves are a response to the huge public demand to bring the rioters to justice. The epetition started by Stephen Mains yesterday it states: ‘Any persons convicted of criminal acts during the current London riots should have all financial benefits removed.

‘No tax payer should have to contribute to those who have destroyed property, stolen from their community and shown a disregard for the country that provides for them.’

Now 100,000 people have signed the petition, it will trigger a process that could end with MPs voting on the plan.

All petitions hitting the landmark total are referred to the backbench business committee, which decides certain motions for Parliamentary debates.

The ATAB, Air Travel advisory Bureau will help co-ordinate legal claims against UK airlines that have not refunded Air Passenger Duty (APD) tax to passengers who have booked tickets but not flown.

Since the tax was first introduced in 1994, ATAB estimates that some airlines have withheld tens of millions of pounds from their customers.

Over the past few months ATAB has been closely monitoring how different airlines behave when it comes to APD refunds.

ATAB has now joined forces with London law firm Barker Gillette LLP in preparing for action. Partner Steven Barker said “Our primary aim will be to ensure that all claims are valid and properly made out. We hope and expect that Airlines will co-operate with us in agreeing and refunding valid claims and that claimants need only seek the assistance of the Courts in respect of legal issues that might not be agreed”.

The original Air Travel Advisory Bureau (ATAB) was established in 1982 by Tony White. It was one of the first flight comparison organisations.
